Terms and Conditions of Sale

The website www.irenepop.shop is operated by “IrenePop by Irene Schmalzl”, with registered office at via delle Leghe 12, 20127 Milan (MI), Italy.
The contractual counterparty to customers is Irene Schmalzl as a sole proprietor/individual business. For any communication, customers can contact the seller at contact@irenepop.shop.

Through www.irenepop.shop, the seller offers exclusively customised T‑shirts featuring original hand‑drawn designs by Irene Schmalzl. Each drawing is created on the basis of a motorcycle photo uploaded by the customer and printed onto the chosen T‑shirt. No standard, non‑customised products are sold; every T‑shirt is clearly personalised according to the customer’s specifications.

Orders can be placed only online via the checkout form available on www.irenepop.shop. To complete a purchase, the customer must provide accurate personal and shipping data, upload a photo of their motorcycle, select size, colour and quantity, and confirm payment via Stripe (credit/debit card, Apple Pay, Google Pay).
By submitting an order, the customer fully accepts these Terms and Conditions and the Privacy Policy in force on www.irenepop.shop at the time of the order.

All product prices on www.irenepop.shop are expressed in Euro (EUR) and represent the total amount payable by the customer, excluding shipping costs and any customs duties borne by the customer. The seller operates under a simplified tax regime; prices displayed on the website correspond to the final amount the customer pays and invoices, where issued, do not show VAT as a separate charge. Price changes will not affect orders already placed and confirmed.

Accepted payment methods on www.irenepop.shop are credit/debit card, Apple Pay and Google Pay, processed via Stripe. Payment is due upon placing the order; the contract is concluded only when the payment is successfully processed. The seller does not apply extra fees depending on the payment method chosen.

Products are shipped worldwide using national and international couriers. Average production time for the hand‑drawn design and printing is 7 working days, plus shipping time depending on destination and courier service. Delivery times shown on the website are indicative and not binding; delays not exceeding 30 days compared to the estimated delivery date do not automatically entitle the customer to terminate the contract.
If a delay exceeding 30 days attributable to the seller occurs, the customer may cancel the order by contacting the seller via email and receive a refund of the price paid for undelivered products. For shipments outside the EU, customs duties, local taxes and import charges are always borne by the customer and are not refunded, even if the product is returned.

Under applicable consumer law, the statutory right of withdrawal for distance contracts does not apply to clearly personalised goods made to the consumer’s specifications. Since IrenePop T‑shirts are custom‑made according to each customer’s request and personalised with a unique drawing of their motorcycle, the customer cannot withdraw from the contract simply because they change their mind or are subjectively dissatisfied with the personalisation. No standard non‑customised products are sold, therefore no general voluntary withdrawal policy is offered.

The customer is entitled to receive goods that conform to the order and are free from defects. Examples of non‑conformity include wrong size, serious fabric or print defects (holes, tears, significant stains, unreadable print), or a T‑shirt colour substantially different from the one selected.
Any defect or non‑conformity must be reported by email within 7 days from delivery, attaching photos and a description of the issue, to contact@irenepop.shop. If a defect is confirmed, the seller may, at her discretion, reprint and resend a replacement T‑shirt free of charge or refund the price paid for the defective product.
Shipping costs for returning clearly defective products are borne by the seller; otherwise, where returns without defects are accepted, shipping costs are borne by the customer. Refunds, where applicable, are issued within 14 days from receipt of the returned goods or confirmation of the defect, using the same payment method originally used.

The customer is responsible for the motorcycle photo uploaded to www.irenepop.shop and guarantees that they have the right to use it, and that it does not infringe third‑party rights (copyright, trademarks, privacy) or contain illegal, offensive or defamatory elements. The seller reserves the right to refuse orders containing manifestly unlawful or inappropriate content or to request a different photo suitable for creating the drawing.
The seller is not liable for claims made by third parties regarding content provided by the customer; the customer undertakes to hold IrenePop harmless from any such claims or damages.

The seller is not liable for delays or failures due to force majeure events or circumstances reasonably beyond her control (strikes, natural events, transport disruptions, customs restrictions). Except in cases of wilful misconduct or gross negligence, the total liability of the seller towards the customer shall not exceed the total amount paid for the order affected by the claim.

Personal data processing is carried out in compliance with Regulation (EU) 2016/679 (GDPR) and applicable Italian law, as described in the Privacy Policy available on www.irenepop.shop. Use of technical cookies and any tracking technologies is regulated by the Cookie Policy published on the website.
These Terms and Conditions are governed by Italian law, without prejudice to mandatory consumer rights under the law of the customer’s country of residence.
